Overview

Keller Williams Saint Cloud ([BROKERAGE LICENSED NAME — e.g. XYZ Realty LLC d/b/a Keller Williams Saint Cloud], "we," "our," or "us") operates the website at https://kwstcloudfl.com (the "Site"). This Privacy Policy explains what personal information we collect, how we use it, who we share it with, and the choices you have. Each office is independently owned and operated.

1. Information We Collect

Information You Provide Directly

  • Contact and lead forms: name, email address, phone number, and any notes or questions you submit when requesting information about listings, scheduling showings, requesting a home valuation, or contacting an agent.
  • Search preferences: property criteria (location, price range, bedrooms, etc.) that you enter to refine your property search.
  • Communications: emails, chat messages, or other communications you send to us, including their content and metadata.

Information Collected Automatically

  • Usage data: pages visited, search queries, listing detail views, time on page, referring URL, and navigation path.
  • Device and browser data: IP address, browser type and version, operating system, screen resolution, and device identifiers.
  • Cookies and similar technologies: session cookies, persistent cookies, and local storage to maintain your session, remember preferences, and analyze aggregate Site usage. See Section 5 for cookie choices.

2. How We Use Your Information

We use the information we collect to:

  • Respond to your inquiries and connect you with an agent.
  • Schedule property showings and consultations.
  • Provide home valuation estimates and market reports.
  • Send you property alerts and listings that match your stated criteria.
  • Improve, personalize, and optimize the Site and your search experience.
  • Comply with legal obligations, including real estate licensing and MLS rules.
  • Send you marketing communications about our services, market updates, and real estate news — subject to your consent where required (see Section 4 below).
  • Detect and prevent fraud, abuse, and security incidents.

3. How We Share Your Information

We do not sell your personal information. We may share it with:

  • Our agents and staff: licensed real estate agents affiliated with Keller Williams Saint Cloud who will follow up on your inquiry.
  • Keller Williams Realty International (KWRI): as required by our franchise agreement, for system-wide CRM, marketing, and training purposes.
  • Service providers: third-party vendors we use to operate the Site (hosting, analytics, CRM, email, SMS platforms), each bound by confidentiality obligations and prohibited from using your information for their own purposes.
  • MLS / IDX data providers: interactions with listing data on this Site are subject to Stellar MLS rules governing consumer use.
  • Legal and regulatory requirements: when disclosure is required by law, court order, or to protect the safety, rights, or property of us or others.

4. Marketing Communications and TCPA Consent

When you submit a contact, lead, showing-request, or valuation form on this Site, you may be asked to consent to receive marketing communications from Keller Williams Saint Cloud and its affiliated agents. By affirmatively checking the consent box (where present) and submitting the form, you expressly consent — under the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, and applicable Florida law — to receive automated or pre-recorded calls, texts (SMS/MMS), and emails from us and our agents at the phone number and email address you provided, even if your number is on a Do Not Call registry.

Consent is not a condition of any purchase or service. You may withdraw consent at any time by:

  • Replying STOP to any text message we send you.
  • Clicking the unsubscribe link in any marketing email.
  • Contacting us directly at [OFFICE EMAIL] or [OFFICE PHONE] .

Message and data rates may apply. Message frequency varies. For help, reply HELP to any text message. Withdrawal of consent does not affect the lawfulness of any processing carried out prior to withdrawal, and we may still contact you for non-marketing transactional purposes (e.g., responding to a direct inquiry you sent to us).

5. Cookies and Tracking Technologies

We use cookies and similar technologies for session management, analytics, and to remember your search preferences. Most browsers allow you to control or disable cookies through browser settings. Disabling cookies may affect Site functionality, including saving your search criteria. We do not currently respond to browser Do Not Track signals, as no uniform standard exists.

Analytics data collected through third-party services (such as server-side analytics) is aggregated and used to improve Site performance; it is not linked to individually identifiable information without your consent.

6. Data Retention

We retain personal information for as long as necessary to provide our services, comply with our legal obligations (including Florida real estate record-keeping requirements, which may extend up to five years), resolve disputes, and enforce our agreements. Lead and contact data stored in our CRM is reviewed periodically and removed when no longer needed for the purpose for which it was collected.

7. Security

We implement reasonable technical and organizational measures designed to protect your personal information against unauthorized access, disclosure, alteration, and destruction. No internet transmission or electronic storage method is 100% secure; we cannot guarantee absolute security. If you believe your information has been compromised, please contact us immediately.

8. Children's Privacy

The Site is not directed to individuals under the age of 18, and we do not knowingly collect personal information from children. If we learn that we have collected personal information from a child under 18, we will take steps to delete that information promptly.

9. Your Rights

Depending on applicable law, you may have the right to access, correct, or request deletion of the personal information we hold about you. To exercise these rights, contact us at the address below. We will respond within a reasonable timeframe and as required by applicable law.

10. Changes to This Policy

We may update this Privacy Policy from time to time. When we make material changes we will update the "Last updated" date at the top of this page. Your continued use of the Site after changes are posted constitutes your acceptance of the revised policy.
